Sie kontextualisiert die Bedeutung der Schaffung eines neuen Regulierungsmodells für die Exploration und Förderung von Erdöl- und Erdgasvorkommen im Bereich der Vorsalzschichten durch einen verfassungsrechtlichen Vergleich verschiedener doktrinärer und rechtswissenschaftlicher Auffassungen. In diesem Sinne ist der zentrale rechtliche Aspekt dieser Veröffentlichung die Ausübung der Tätigkeiten, die Teil des der Union zugesicherten Monopols sind, wobei die Notwendigkeit der Gründung eines neuen staatlichen Unternehmens zu diesem speziellen Zweck in Betracht gezogen wird.

It contextualises the importance of establishing a new regulatory model for the exploration and production of oil and natural gas reserves in the pre-salt layer area, through a constitutional comparison of various doctrinal and jurisprudential understandings. In this sense, the central legal aspect of this publication is the exercise of the activities that are part of the monopoly assured to the Union, considering the need to establish a new state-owned company for this specific purpose.
