Despite multiple efforts on the bilateral, regional and multilateral level to create uniform or at least harmonized rules for commercial operations and practices in the maritime transport sector and to liberalize maritime transport services by tearing down the barriers that exist in that sector, there is until today no global regime regulating (or rather deregulating) the supply of maritime transport services and ensuring open markets. In this situation, private economic actors are confronted with substantial legal uncertainty.
This book provides a detailed analysis of the history...

Oil tankers are not the only vessels that have caused oil pollution at sea. Numerous spills in the past have been of heavy fuel oil from non-tankers. However, the international liability and compensation regime covered only oil pollution damage caused by oil tankers. There was thus a need to bring the law on marine oil pollution responsive to oil pollution damage caused by non-tankers. In March 2001, the International Convention on Civil Liability for Bunker Oil Pollution Damage was adopted following a diplomatic conference at the International Maritime Organization. Though this convention...

Marine Insurance is considered one of the oldest of the many forms of commercial protection. It has flourished through the establishment of the institution of the ''coffee-houses'', wherein ''underwriting" was being conducted and from where the evolution and dominance of the Lloyd's has stemmed as the world's most famous insurance market. Marine insurance contracts are special in that they have special characteristics and also be cause they are contracts of indemnity. Designations of large Particularly Sensitive Sea Areas (PSSAs) triggered a controversial debate within the International Maritime Organisation (IMO) concerning the legal basis of PSSAs, the relationship between the IMO's PSSA guidelines and UNCLOS, as well as the competency of IMO to adopt mandatory protective measures in these areas. As a result, IMO conducted a review process which led to substantially updated guidelines adopted in late 2005. This book provides a detailed analysis of the PSSA guidelines and protective measures available in PSSAs. Emphasis is placed on their legal basis and...

The ocean tides are the most prominent forced oscillations in the global ocean. Recent research showed that tides play an important role for the earth's climate system and they are of considerable interest for the post-processing of satellite data. To understand these oscillations it is substantial to determine and analyse the free oscillations, which describe the oscillation behaviour of the global ocean. A highly efficient ocean model is developed to compute these free oscillations with explicit consideration of dissipative terms and the full ocean loading and self-attraction (LSA). The...

Dr Yang's book deals with the port and coastal State's jurisdiction over foreign merchant ships as well as with the rights and duties of these ships in the internal waters and in the territorial sea. The international law is rather different in both situations. Despite the fact that it faces a number of issues such as, for example, a contested right of access to ports or conditions for port access requirements, the law of foreign merchant ships in internal waters has never been codified. On the other hand, already the League of Nations considered the law of the territorial sea as appropriate...

In May 2005, the International Max Planck Research School for Maritime Affairs organized an international conference addressing marine pollution. At the conf- ence venue, the International Tribunal for the Law of the Sea, academics and practitioners debated recent developments from an interdisciplinary perspective. The papers shed light upon ecological aspects, upon the efforts of the international community to prevent and combat marine pollution by appropriate institutions and regulations, and upon the compensation of losses which have occurred despite those efforts. The present volume...
