Das ESUG hat mit der Starkung des Einflusses der Glaubiger, der Ermoglichung von Eingriffen in Gesellschafterrechte und der Forderung der Eigenverwaltung das Insolvenzrecht nachhaltig verandert. Die Judikatur des BGH hat seit Inkrafttreten der InsO auf deren dogmatischen Gehalt Einfluss genommen.
