The number of deaths due to traffic accidents is considerably high, and this percentage may be much higher, since not all accidents are counted, due to the fact that this data does not reach the competent authorities. Among the many traffic accidents are those caused by drunk drivers. Even though the legislator has established this crime in the legal text, accidents of this nature are still quite common, not least because of the unreliability of breathalyzers. In view of this, the problem posed by this monograph was: Despite its aim of curbing the high incidence of traffic accidents, has the Dry Law (Law No. 11.705/08) really had an effect, especially with regard to the crime of drunken driving, a crime with the greatest repercussions on society? In order to answer the problem in question, the general objective of this monograph was to investigate drunken driving in terms of the requirements for the configuration of the crime. In order to produce this work, bibliographical research was carried out on published materials that deal with the subject in question, by renowned authors in the field.
