Anglo-American Securities Regulation: Cultural and Political Roots, 1690 1860

Banner, Stuart
This book examines the regulation of the earliest securities markets in England and the United States, from their origins in the 1690s through the 1850s. Professor Banner argues that during the reign of Queen Anne a complex and moderately effective body of regulatory control was already extant, reflecting widespread Anglo-American attitudes toward securities speculation. He uses traditional legal materials as well as a broad range of nonlegal sources to show that securities regulation has a much longer ancestry than is often supposed.

Death Penalty: An American History (Revised)

Banner, Stuart

The death penalty arouses our passions as does few other issues. Some view taking another person's life as just and reasonable punishment while others see it as an inhumane and barbaric act. But the intensity of feeling that capital punishment provokes often obscures its long and varied history in this country.

Now, for the first time, we have a comprehensive history of the death penalty in the United States. Law professor Stuart Banner tells the story of how, over four centuries, dramatic changes have taken place in the ways capital punishment has been administered and experienced....

How the Indians Lost Their Land: Law and Power on the Frontier

Banner, Stuart

Between the early seventeenth century and the early twentieth, nearly all the land in the United States was transferred from AmericanIndians to whites. This dramatic transformation has been understood in two very different ways--as a series of consensual transactions, but also as a process of violent conquest. Both views cannot be correct. How did Indians actually lose their land?

Stuart Banner provides the first comprehensive answer. He argues that neither simple coercion nor simple consent reflects the complicated legal history of land transfers. Instead, time, place, and the...

Possessing the Pacific: Land, Settlers, and Indigenous People from Australia to Alaska Banner, Stuart 9780674026124 Harvard University Press
Possessing the Pacific: Land, Settlers, and Indigenous People from Australia to Alaska

Banner, Stuart

During the nineteenth century, British and American settlers acquired a vast amount of land from indigenous people throughout the Pacific, but in no two places did they acquire it the same way. Stuart Banner tells the story of colonial settlement in Australia, New Zealand, Fiji, Tonga, Hawaii, California, Oregon, Washington, British Columbia, and Alaska. Today, indigenous people own much more land in some of these places than in others. And certain indigenous peoples benefit from treaty rights, while others do not. These variations are traceable to choices made more than a century...

A collection of curious tales questioning the ownership of airspace and a reconstruction of a truly novel moment in the history of American law, this book reminds us of the powerful and reciprocal relationship between technological innovation and the law in the past as well as in the present.

Baseball Trust: A History of Baseball's Antitrust Exemption

Banner, Stuart
The impact of antitrust law on sports is in the news all the time, especially when there is labor conflict between players and owners, or when a team wants to move to a new city. And if the majority of Americans have only the vaguest sense of what antitrust law is, most know one thing about it-that baseball is exempt.

In The Baseball Trust, legal historian Stuart Banner illuminates the series of court rulings that resulted in one of the most curious features of our legal system-baseball's exemption from antitrust law. A serious baseball fan, Banner provides a thoroughly...

Speculation: A History of the Fine Line Between Gambling and Investing

Banner, Stuart
What is the difference between gambling and speculation? This difficult question has posed a legal problem throughout American history. Many have argued that periodic failures by regulators to differentiate between the two have been the proximate causes of catastrophic economic downturns, including the Great Depression and the 2008 global financial crisis.
In Speculation, Stuart Banner provides a sweeping history of how the fine lines separating investment, speculation, and outright gambling have shaped America from the 1790s to the present. Advocates for risky investments have...
