Nach dem so genannten Hohenzollern-Beschluss des BVerfG herrscht in Literatur und Rechtsprechung weitgehend Einigkeit, dass Potestativbedingungen in letztwilligen Verfugungen dann sittenwidrig sind, wenn sie den Betroffenen einem unzumutbaren Druck aussetzen. Diese Arbeit tritt dieser Auffassung mit dem Postulat weitestgehender Gestaltungsfreiheit des Erblassers entgegen. Analysiert wird dazu u.a. die deutsche Rechtsprechung zu sittenwidrigen Potestativbedingungen seit 1888."
