This book aims to trace and analyse the development of legislation concerning defamation in the UK and Italy and its application to cases of libel from the past to the present, highlighting the position of Internet Service Providers (ISPs) regarding liability. The study tries to show just how divergent regulation in Italy is from that of the UK. It gives an extensive overview of the legislation in both jurisdictions. It also carries out a critical analysis which considers whether the UK and Italian legislation is sufficient or needs any changes, in order to guarantee a balance between freedom of expression and protection of reputation. Insights into recent proposals for reform are also underlined to undersand the way forward concerning the governance of the Internet and which direction future legislation should and may take in the light of new suggestions.
