Until recently, the rapid growth of the Japanesee-commerce industry was not paralleled with anincrease in privacy legislation to safeguard onlinepersonal information. The Japanese bureaucracyattempted to fill this vacuum by releasingself-regulatory guidelines that were originallypromulgated in the United States. However, theresults of a content analysis showed that in spite ofthis, Japanese Web sites still lagged far behindtheir American counterparts in the development ofeffective privacy policies. The author posits thatthe ineffectual emulation of American made guidelineswas due to the varying cultural standards that arefound in both countries. In particular, an attemptwill be made to focus on the role of studiednonobservance as a direct impediment towards thedevelopment of effective privacy legislation inJapan. With the conduct of e-commerce beingtrans-boundary and the Japanese people pressing forstronger judicial enforcement, it is perhaps time forindustry and government leaders in Japan to rethinktheir strategy of enacting privacy protectionsafeguards based on traditional Japanese culture.
