This Part will essentially use the text from the previous edition as the starting point, but updating it to take account of developments. Chapter 1 : A Brief History of the NEC3 family of contracts. Chapter 2 : How Clarity & Simplicity are achieved : would also introduce risk strategy principles Chapter 3 : How Flexibility is achieved : Main Contract options, Secondary Options (X1 –X20) + other options & aspects of flexibility.. Chapter 4 : The mechanisms for Stimulating Good Project Management Chapter 5 : A Quick Run through of the contract focussing on the Engineering & Construction Contract, but with some reference to others. Part II : Implementation. Instead of having in depth interviews (as per the 2nd edition book), this book will go straight to Implementation (Part III previously). However, this Part will instead be peppered with short case studies and vignettes to illustrate any theory. Apart from this, it will substantially follow the form of the 2nd edition book, but updated to take account of changes in the contract e.g. the addition of the Risk Register and other advances in good practice. Chapter 6 : Pre-tender including : Preparation of the Contract Documentation; Specifying Programme Requirements; Completing Part 1 of the Contract Data, inc. filling in the Risk Register; risk allocation process; & Other issues. Chapter 7 : Preparing the Tender, including : Accuracy; Programme and the activity schedule; Understanding the different Schedule of Cost Components (SCC); Filling in Part II of the Contract Data, inc the Risk Register. Chapter 8 : Evaluating the Tender, including : Evaluating the Effect of the Tendered Percentages; Quality Bids; Other Issues. Chapter 9 : Post Award, including :Training; Programme; Communications; Open Book Accounting. Chapter 10: Implementing the Contract including Payment; Early Warnings and the Risk Register; Levels of Use of the Programme; Agreeing the Time and Cost Effect of Minor Compensation Events; A Methodology for Agreeing the Cost of Major Compensation Events; Avoiding & Winning Adjudications. Part III : Advanced Practice : This Part focuses on advanced practice and how it can be done under the NEC. This includes : Chapter 11: Use of Incentives to Stimulate High Performance (inc. Value Engineering Clauses). It is typical practice to put negative incentives i.e. damages in contracts, yet research indicates that, if anything, they have a negative effect on project performance, whilst positive incentives i.e. bonuses, are far more likely to have a beneficial effect. This chapter will promote this and show people how to develop simple effective incentive schemes using the NEC option X clauses. It will also comment on how to define the Works / Service Information or Scope to achieve this. Chapter 12: Communications using IT as enabler : there are now at least 4 server based systems on the market for managing communications under the NEC, as well as one utilising the functionality of Outlook. The key functionality required will be reviewed, so that readers can intelligently review the different systems to select one that best fits their needs and budget. Chapter 13: Earned Value Analysis (EVA) with activity schedules. Earned Value is a simple (but often in explanation and practice over-complicated) way of integrating the reporting of time, cost and value delivered on a project, so that participants and stakeholders know exactly its status. This chapter will explain what EVA is, how the use of activity schedules aligns itself very well with EVA and how in simple steps to do it. Chapter 14: Threat & Opportunity Management primarily under target cost arrangements – but potentially also with VE clauses under options A or B - to give the Employer the maximum value for their budget. It builds on the previous chapter as each party has to know where the project is in order to determine how much can be re-invested back into the contract. Chapter 15: The Last Planner TM technique is a technique which applies the concepts of ‘lean thinking’ to a project environment in order to reduce time and promote greater certainty over the duration of operations. When and how to do this in a contractually compliant and workable way will be explained. Chapter 16: Critical Chain project management (CCpm) : CCpm is a genuinely new paradigm in how to programme & then manage a project, with durations of stand-alone projects typically being reduced by over 20%. Yet it is not universally applicable and needs different monitoring system and culture in place to make it work. This chapter will explain what it is, when to use and, if suitable, how to do it in accordance with the NEC programming provisions.
