The transport of oil and hazardous and noxious substances by sea is a global problem in that it affects the safety of human life, the safety of navigation, the integrity of property and interests (ships, cargoes and freight) and the preservation of the marine environment and its animal and mineral wealth. It is therefore clear that this industry is potentially dangerous and creates casualties located either at sea or on land. The primary, and at the same time ultimate, objective is SAFETY. To address and achieve this we turn to technology, navigational science, naval architecture and legislation. Legislation arises in the domestic order and international production, being its framework very broad: administrative, planning and police, civil and commercial, criminal and environmental, coexisting Public Law with Private Law, that is to say, State intervention and the autonomy of contracts.
