The contract is in urgent need of a change in its current role. It should not be assumed as a simple formal document that validates the will of the parties involved, but should be conceived as an effective legal instrument that has a transcendental role in the efficient performance of our business system. This paper analyzes the main shortcomings that persist today in the process of economic contracting in the field of inter-company relations in Cuba, making special reference to the role that the contract should play as an essential instrument of economic management that contributes to a better performance of our companies and ultimately of the economy. As regards contracting with the Non-State Management Sector, not all the specialists in this process (economists, salesmen, accountants, technicians and lawyers) participate jointly; the contract negotiation is not effective; the required modalities of agreement are not adopted in each case; and the legal advisors do not always assume active positions in the different stages, including the negotiation.
