There are ancient historical roots of the individual rights and legitimate interests in the criminal process, the moral, religious, scientific and other approaches, views and legal norms to guarantee these rights and interests. Like all other areas of the legislative work and the implementation of the law in the world countries, this area had a contradictory historical development course from the first laws of the civilization till the modern regulatory legislation. However, since the mid of the last century the problem of the individual rights in the criminal process has become the object of further theoretical research, the points of the Soviet legislation putting the personal interests, humanist and democratic values on the background were blamed, and numerous proposals were made for their elimination.
